Buying a house, a piece of property, or a business seems a relatively easy thing to do. You make an offer to the realtor who either rejects or accepts it and you reach a compromise. Done! You move in and cut the grass.

And if you're buying an income property, the most important element is the amount of rent that's being collected, how long the tenant has been there and what the prospects are for the property appreciating. Lay back and wait for the cheques to arrive.

Were it only that simple, for this is an area that's fraught with peril for both buyers and sellers. In fact, buying a home is the biggest single cash outlay you'll likely ever make. People often don't realize that an offer to purchase a home is a contract. You can't just change your mind. When you sign an offer, you're saying that you will buy the house for a certain price on certain conditions.

Our job is to make sure you know what you're agreeing to before you sign anything and then, on the closing date, that you really own the house, you paid the right amount for it, and all the paperwork is complete and correct. We'll check that the person selling you the house has a right to sell the house and that no one else has a claim to it, such as mortgage holders, unpaid contractors, tenants, and the spouse of the person selling the house. We'll contact the municipality or regional district to make sure that the property does not violate any by-laws or zoning regulations and that all taxes have been paid.

We'll check about any special restrictions on the property. For example, others may have a right to use your property to get to their property or for hydro or telephone lines. There may be municipal regulations concerning swimming pools or septic tanks on special environmental and conservation rules. If you are buying it with someone else, we'll explain the difference between being joint tenants or tenants in common.
