Accident and Injury Claims
What a close call that was! By the looks of your car, you shouldn't have been able to walk away from that one. And the other guy's pickup hardly had a dent. So what's he doing shouting at you like it was your fault? It was him who went through the red light!
Motor vehicle accidents are fairly common and chances are good that you'll one day be involved in one. There are things you can do that will help you in making your claim with ICBC or other companies and agencies.
If you're the driver and have a camera, take photos of the accident scene before any vehicles are moved, making sure it is safe to do so. Then move your car to the side of the road to avoid causing another accident. Get the name, address, phone number, drivers licence number and the licence plate number of the other driver.
Once you've done that, get the names and phone numbers of all witnesses to the accident; draw a map of how the accident happened, showing what lanes your car and the other car(s) were in, and the direction of travel of each vehicle. Write down how the accident happened while the facts are fresh in your mind, including the speed you were travelling, the weather conditions, and particulars of your conversation with the other driver.
Report the accident to the RCMP as soon as possible and at the very latest within 48 hours and report the accident to the nearest ICBC office as soon as possible. If you have any concerns, you have the right to consult or retain a lawyer before doing so.
If you are injured, you may be entitled to wage loss, medical or rehabilitation benefits under your insurance plan through your employer and you should contact them for details. If you do not have such an insurance plan, you may be entitled to similar benefits from ICBC.
While you have a duty to advise ICBC in a timely manner of your claim, you have the right to consult or retain a lawyer before doing so.
